Evictions for non-payment prohibited until December 31, 2020

Evictions for non-payment of rent have been suspended, throughout the country, until December 31, 2020. The order was issued by the Center for Disease Control and Prevention, on September 4, due to the risks that evictions can pose to public health. However, tenants will continue to be responsible for the payment of rents, late fees, penalties and accrued interest, in accordance with the provisions of their contracts.

In order to obtain the benefit of the stay of eviction, tenants must sign and send the homeowners an affidavit stating that:
1. They do not have annual income of more than $ 99,000, in the case of people who do their taxes individually; no more than $ 198,000, in the case of couples filing taxes jointly;
2. There is a high possibility that they will have to live on the street in case of being evicted; and,
3. They make partial payments to the extent circumstances allow.

Homeowners who violate this order could face criminal charges imposed by the federal government.
